
In a HUGE victory for President Trump and the rule of law, the far-left district court ruling by Biden-appointed Judge Trina Thompson has just been smacked down by the Ninth Circuit Court of Appeals.
For years, the left has exploited Temporary Protected Status (TPS), a supposedly “temporary” program, as a backdoor amnesty pipeline, keeping tens of thousands of foreign nationals on U.S. soil long after the disasters and conflicts in their home countries ended.
Instead of encouraging return and rebuilding, Democrats and their activist judge allies turned it into a forever welfare pass.
On Tuesday, a three-judge panel of the Ninth Circuit, Judges Hawkins, Callahan, and Miller, granted the government’s motion for a stay, effectively halting Judge Thompson’s July 31 order that had blocked the Trump administration from moving forward with ending TPS for more than 60,000 migrants from Honduras, Nicaragua, and Nepal.
Those individuals had been allowed to remain under extended protections until at least November 18 while litigation over TPS status continues.
The stay now paves the way for the Trump administration to end TPS for:
- 7,000 Nepalis, whose protections expired on August 5, 2025, and
- 54,000 Central Americans—consisting of 51,000 Hondurans and
- 3,000 Nicaraguans—whose TPS is scheduled to expire on September 8, 2025
With the stay in place, these individuals will soon become eligible for removal and lose the ability to legally remain and work in the U.S.

The Gateway Pundit previously reported that U.S. District Judge Trina Thompson, who is based in the People’s Republic of San Francisco, barred the Trump Administration from cancelling Temporary Protected Status (TPS) for migrants from the following countries: Nicaragua, Honduras, and Nepal.
The Biden appointee ruled not based on the Constitution but because she saw perceived racial animus. She falsely accused Noem of using terms from “the discriminatory belief that certain immigrant populations will replace the white population,” aka The Great Replacement Theory.
Thompson also called President Trump a racist, pointing to a truthful statement he made in 2023 where he denounced criminal illegal aliens for “poisoning the blood of our country.”
And she accused Trump and Noem without evidence of linking TPS recipients with criminal aliens.
“Color is neither a poison nor a crime,” Thompson said.
“The freedom to live fearlessly, the opportunity of liberty, and the American dream. That is all Plaintiffs seek. Instead, they are told to atone for their race, leave because of their names, and purify their blood,” she added. “The Court disagrees.”
