BREAKING: Corrupt Obama Judge Extends TRO Reinstating Fired Biden Holdover Hampton Dellinger

Judge Amy Berman Jackson (L); Hampton Dellinger (R)

The US Supreme Court must intervene.

Corrupt Obama Judge Amy Berman Jackson extended a Temporary Restraining Order (TRO) reinstating fired Biden holdover Hampton Dellinger after a dramatic hearing on Wednesday.

The TRO was extended through Saturday, March 1.

President Trump fired Hampton Dellinger, Special Counsel of the Office of Special Counsel (not to be confused with a special counsel hired as a federal prosecutor) a few weeks ago.

However, shortly after the firing, Judge Jackson sided with Hampton Dellinger, issued an administrative stay, and allowed him to keep his job.

President Trump filed an emergency application to the US Supreme Court, however, the high court held Trump’s emergency request “in abeyance”, which means that the court could make a decision at a later date.

Judge Jackson held a hearing because the TRO reinstating Hampton Dellinger was set to expire on Wednesday, February 26.

DOJ counsel argued that President Trump, under Article II, can fire subordinates for no reason.

17/ DOJ: Exactly. You can remove for no reason.
Judge: She is making a policy argument which is totally inappropriate given issues.
DOJ: Part of Article II authority is to remove direct subordinates for any reason.
Judge: This seems different from any other agency. Because it…

DOJ lawyers rightly argued that Judge Jackson has ZERO authority to reinstate Dellinger. The DOJ argued Judge Jackson’s order reinstating Dellinger infringes on a President’s power.

21/ DOJ: Accountability of SC to President is what is at stake. Even if SC is fired at will, OSC will continue to function.
Judge: Argued to SCOTUS I lack authority to reinstating Dellinger. Plaintiffs say no, they aren’t asking for an injunction to President. Do I have authority…

Shortly after Wednesday’s hearing, Judge Jackson extended the TRO through Saturday, signaling she may grant a preliminary injunction.

“In consideration of all of these circumstances, then, the Court finds, pursuant to Rule65(b)(2), that there is good cause to extend the temporary restraining order for an additional three days, through Saturday, March 1, so that the status quo will be preserved for the brief period of time it takes to complete the written opinion on the consolidated motion for preliminary injunction and cross motions for summary judgment. SO ORDERED,” Amy Berman Jackson wrote in a 5-page order reviewed by The Gateway Pundit.

Emboldened by the Supreme Court’s refusal to intervene, Hampton Dellinger is causing problems and attacking President Trump’s decision to terminate “probationary” employees.

In a statement released on Monday, Hampton Dellinger said some of Trump’s firings of probationary employees appear to be illegal.

“Last Friday, Special Counsel Hampton Dellinger filed initial requests to “stay,” or pause, the apparently impermissible terminations of six probationary employees across various executive branch agencies. The requests, filed with the U.S. Merit Systems Protection Board (MSPB), seek a 45-day stay of the terminations because there are reasonable grounds to believe that agencies engaged in prohibited personnel practices (PPPs) under 5 U.S.C. § 2302(b)(12) by terminating the employees in violation of federal laws and regulations governing probationary terminations and reductions in force,” Hampton Dellinger’s office said.

Late Tuesday evening, the Merit Systems Protection Board ordered a 45 day stay on Trump’s firings of 6 employees.

The federal agency will also explore ways to expand the order to halt firings of other probationary employees.
