
One of the Supreme Court Justices who dissented in yesterday’s Supreme Court ruling on nationwide injunctions was echoing conservatives not so long ago.
As TGP’s Jim Hoft reported, the United States Supreme Court delivered a powerful rebuke of activist judges and handed President Trump a pivotal legal victory on Friday.
The decision in Trump v. CASA, Inc., reaffirms the rightful balance of power between the judiciary and the executive, curbing the ability of unelected district judges to paralyze the will of a duly elected president. In a 6–3 decision, the Court ruled that federal district courts lack the constitutional or statutory authority to issue so-called ‘universal injunctions’ — sweeping orders that block government policies nationwide, often at the request of left-wing advocacy groups.
Justices Elena Kagan, Sonia Sotomayor, and Ketanji Brown Jackson were in the minority.
But it turns out Kagan was on the right side just a few years ago. On CNN last night, Scott Jennings revealed that Kagan made the exact same complaint about lawless district judges as so many MAGA supporters.
“In 2022, Justice Kagan actually gave an interview and said out loud what a lot of conservatives have been saying this year, which is that how can it be that an individual district court judge can issue a nationwide injunction and effectively grind a presidency to a halt and, you know, take years and years and years for it to go through the process?” Jennings stated.
“Now, she obviously voted the other way this time around. I wonder what caused her to change her opinion.”

Jennings is right. In September 2022, Kagan told an interviewer at Northwestern Law School that it made no sense for one unelected district judge to stop national policy.
“It just can’t be right that one district judge can stop a nationwide policy in its tracks and leave it stopped for the years that it takes to go through the normal process,” she says in part.
