
On Tuesday, the J6 community received some good news from Attorney Carolyn Stewart. Elias Costianes is to be released. As earlier reported by The Gateway Pundit, Elias was forced to turn himself in to the Bureau of Prisons on February 12th, 2025, just weeks after receiving a full Presidential Pardon. He was being incarcerated for charges he obtained from the raid on his home for his attendance on January 6th.

After his appeal for an extension was denied, Costianes reluctantly self-surrendered to the Northeast Ohio Corrections Center (NEOCC) on February 12th. Attorneys Carolyn Stewart and Roger Roots filed an Emergency Motion and waited for the DOJ’s response, which came a week later, on the 19th.
In the government’s reply to the motion, Assistant US Attorney (AUSA) David Bornstein said,
“After consulting with the Department of Justice’s leadership, the United States has concluded that the President pardoned Mr. Costianes of the offenses in the indictment,” Bornstein wrote. “This determination by the Executive is ‘conclusive and preclusive.’”
The next day, February 20th, Stewart and Roots filed their answer to the government’s reply.
The filing by Stewart concurred with the government and supported their conclusion, ”The government agreed that Mr. Costianes’ case falls under the Presidential Pardon, and that he should immediately be released from incarceration.” It continues, “He [Costianes] respectfully requests that this Court order that the U.S. Marshals and BOP immediately release Mr. Costianes from the Northeast Ohio Corrections Center (NEOCC) where he is presently incarcerated, vacate the judgment of the district court, moot the current appeal in this Court, and remand the case to the district court with instructions for dismissal.”
Over a month had passed since the reply was sent to the court, and Maryland Fourth District Federal Judge James K. Bredar continued to hold Elias Costianes hostage. In fact, the government filed a second motion for Elias’ release.

The Obama appointee seemed to be completely MIA, on vacation, lost, or just disappeared even after a joint motion was filed on March 13th. He would not answer or release Costianes, and the AUSA says that the Marshals, who work for the Department of Justice, will not release Costianes without a court order. Which also brought up some questions about why Pam Bondi would not step in.

This all leads us to Tuesday, three months later and four months almost to the day, when Elias self-surrendered to prison. Elias Costianes is a free man.

On Tuesday, Carolyn Stewart relayed a message from Elias. “Elias is grateful to all who prayed and supported him during this tough time.”
